    is parking with the rear to the kerb illegal?

     

    Hi Guys,

    I parked this morning on Hospital Road in Sydney's CBD (the road that runs along the back of Sydney Hospital and the Domain) as I always park - rear to kerb, on a 90 degree angle in between two cars (leaving a few metres each side). However I just got a $175 parking fine for "cause/permit vehicle to stand park contrary to sign" - the cars were parallel parked.

    I only did my P's test last week in Clyde where I was taught to park like this.

    How do other riders park? Have I been doing the wrong thing? Can I contest this?

    Motorcycles may angle park anywhere it is legal to park,

    even if a sign shows parallel parking. Make sure, however,

    that your motorcycle does not stick out further than any

    parallel parked vehicle.

     Good question don't now but i always park the bike in angle parking spaces facing out  toward the road for a better getaway and have never been fined . i know in some towns the signs say cars to reverse in to angle parks . Also In some places with the camber running down to the curb the bike could run forward and of the side stand if you parked with the front wheel facing the curb . Maybe you could use that as a defense . let us know how you go on sound like you have been unlucky . Ups read it wrong you where in a parallel parking area in that case i park parallel maybe with the bike facing  slightly to the road

    If you have a go and defend it in court Id say that you'd have a fair chance of argueing your case successfully. But be prepared to have  a day off work because you'll be in court all day, because generally they leave the contested cases to last. If you hang around inside the court though, you will see some very funny cases and hear some outrageous excuses. It can be a real eye opener.

    Traded in the Daelim for a Suzuki DR650. Keeping the Vespa GTS250ie though.

    I always park rear to curve. Most motorcycles dont have reverse, and its safer to read out into the road forward, rather than stepping the scooter in reverse. Also, the camber of most roads can cause the scooter to step off its stand if facing towards the curb. If our local park inspector fucks with me again, I'll raise his blood pressure again with my horn.

    You will probably find that "contrary to sign" means you have parked two vehicles per bay or exceeded the time limit.

    From memory, Hospital Rd does not have "angle parking or parallel parking" indicators - and as this area is governed by Botanic Gardens Trust instead of Sydney City Council, you will need to address your complaint to State Debt Recovery.

     How does one find words to describe the actions of some BODS,i would defy you to find any judge in the land that would find you guilty,i reckon the parking cop would have to be some creature about 2 foot in height?.Actually here in nowra i know that one of our local highway patrol guys would threaten to book you for obstruction if you parked multiple bikes/scooters in the paralell fashion that the cars must do,his reasoning is--"you can fit a least 4 bikes into one car spot",it is interesting also that here in nowra some yrs back we had this council employed very horrid little 2 foot high "bomber" who would probably even give himself a ticket,anyway he came to a sticky end because one day these 2 big cranky dudes put him into a roadside bin headfirst,man what a sight it was--his little legs going ten to the dozen and this loud echo/scream noise coming from inside the binBig Smile---this is a true story and was actually in the local paper--pictures and all.

    Yep, I reckon you're right Jax. Squeezing in between a couple cars is not considered legit in most cities. Incl Launceston

    how long did u park? what was the time limit on the sign? eg 2hr metered. did u over stay the time max limit?

    jax, r bikes in sydney city council area allowed to park free in bayed\metered marked spots up to the max time limit? also, does the scc "free parking" cover the spots in the other authorities like botanic gardens and harbour foreshore?

    Well here in Melbourne we don't have these problems. I park on the footpath, preferably next to a no standing zone, for an easy exit and out of the way of car doors, for as long as I like, whenever I like. And its legal. We can thank bikies this law is still in place.

    The case in this thread is looking guilty if what Tascam pointed out is correct.

     Hi Guys,

    Thanks for all the responses! It was sign posted as 4 hour parking, I parked at 8.30am and was booked at 9.05am. Interestingly enough, the scooter that was parked next to me already and in the same manner (and was still there when I came back at midday to move my scooter) was not booked.

    I am contesting the fine and have submitted the following statement along with a copy of the infringement notice, a photo of the sign and page 136 of the RTA Road Users handbook detailing motorcycle parking.

    Reason for request

    My request for review is made on the basis that the offence notice (General Penalty Notice XXXXXXX) has been issued in error and that the offence noted does not apply to the circumstances in which my vehicle (a motor scooter) was parked.

    I have held a NSW Drivers Licence since 1 September 1999, and during this period I have not had any offences recorded on my driving record, previous convictions or relevant court convictions. I currently also hold a Provisional Motorcycle Licence.

    The offence notice specified the following offence: ‘Cause/permit vehicle to stand/park contrary to sign.” The area in which the alleged offence occurred was signed,‘4P Meter 8am – 8pm’, and allowed for parallel parking. Being that my vehicle is a motor scooter, it does not require a ticket to park and is able to be angle parked even where the parking bays are for parallel parking.

    The subject of the alleged offence was for parking contrary to the sign, presumably for not parking in parallel. I refer to page 136 of the Road User’s Handbook (Road & Traffic Authority, NSW) which states the following: “Motor cycles may angle park anywhere it is legal to park, even if a sign shows parallel parking. Make sure, however, that your motorcycle does not stick out further than any parallel parked vehicle.”

    My motor scooter was angle parked and did not protrude past the vehicle that I was parked next to. I took-up a marked space and left ample room for other vehicles to gain access to the parking bays next to me.

    On that basis, I object to the notice of offence and request a review of this General Penalty Notice. It is clear that I have not been in breach of parking regulations and have not committed the offence as specified in the notice.
